2. Carrier Disclaimer

Empire Business Solutions & Advertising is not liable for delayed or undelivered messages. Carriers do not guarantee message delivery. Availability and functionality of SMS services may vary by carrier and device.

3. Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts to use our services. By using our site, you represent and warrant that you meet these requirements.

4. Acceptable Use

You agree not to misuse our website, forms, chat widget, or SMS program. Prohibited conduct includes providing false information, attempting to disrupt service, sending unsolicited communications, or using our systems for any unlawful purpose.

5. Services & Payment

The Business Growth Diagnostic is offered at $495, payable at booking. Your diagnostic is not fully confirmed until payment is completed. If you move forward with implementation, the diagnostic fee may be credited toward your setup fee at our discretion. Implementation, software, and management fees are scoped during the diagnostic and agreed upon in writing before work begins.

6. Limitation of Liability

Empire Business Solutions & Advertising provides consulting and system implementation services. We do not guarantee specific revenue, lead, or business outcomes. To the maximum extent permitted by law, our liability for any claim arising from your use of our services is limited to the amount you have paid us for the service in question. We are not liable for indirect, incidental, or consequential damages.

7. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York.
